Arizona Reaches Legal Agreement On Legislation “Show Me Your Papers”

The state of Arizona reached a legal agreement to establish clear and precise rules on how police departments must apply the “show me your papers” state law SB1070, it was reported today.

Victor Viramontes, representing the Mexican American Fund for Legal Defense and Education Fund (MALDEF), told a news conference that an agreement with the Office of the Attorney General of Arizona ending a long legal fight in the courts against achieved SB1070, originally passed in 2010.

As part of the legal agreement, specified -for the first time- that police departments can not arrest a person only because of their immigration status but there should be a legal “reason” or a violation of state law.

Police officers, once they finish processing the traffic offense or the legal grounds for detention must release the detainee even an illegal immigrant.

Previously, police departments have had the power to question the immigration status of detainees if “suspected” that were undocumented and stopped for long periods until the arrival of Immigration or Border Patrol.

As part of the agreement, the state also agreed to withdraw an appeal against another part of the SB1070 criminalizing workers who work on the streets and another section that allowed police to confiscate the car of a person if transporting an undocumented immigrant, whether a family member or not was also eliminated.

Alessandra Soler, director of the American Civil Liberties Union (ACLU) said that this agreement ends legal action against SB1070, which reached the Supreme Court in 2012 and removed much of SB1070, but maintained section 2 (b), better known as “show me your papers.”

“We are very aware that this agreement will be implemented by each police department and insure that no civil violations occur,” said Soler.

Meanwhile, the attorney general of Arizona, Mark Brnovich, said in a statement that this agreement will also save taxpayers money by allowing the state to move forward.
